Manslaughter charges for Santa Cruz driver who fell asleep at the wheel

Unlike many cases in which a cyclist fatality is dismissed as a tragic accident, justice may be on the way for Santa Cruz cyclist Joshua Alper, who was killed when Navindra Jain, also of Santa Cruz, allegedly fell asleep at the wheel of his Tesla last November 2013.

Santa Cruz District Attorney Bob Lee announced his office will charge Jain with misdemeanor vehicular manslaughter after three months of investigation.

He was allowed to drive because of the same anti-cyclist bias that condemned a cyclist in SF to a felony manslaughter charge for killing a man yet gives Mr. Jain only a misdemeanor for analogically the same act. Though if one reviews the facts of these cases Mr. Jain’s offense is the one much more serious and more deserving of a felony charge.
